Terms of Service — Brunhart AI

These Terms of Service ("Terms") govern your access to and use of products and services offered by Brunhart AI ("Brunhart AI", "we", "us"), including FactoryBuddy. Please read them carefully.

1. Acceptance of terms

By creating an account, downloading, or otherwise using our services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the services. If you are using the services on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of service

FactoryBuddy is an AI-assisted operations app for traders and manufacturers. It allows users to photograph handwritten trade slips, use voice commands in Hindi, Punjabi, and English, and generate a digital ledger and GST-style invoices. Features evolve over time; we may add, change, or remove features at our discretion.

3. Eligibility & accounts

You must be at least 18 years old and capable of forming a legally binding contract to use the services. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.

4. User responsibilities

You are responsible for the accuracy of the data you enter into or upload to the services, including handwritten slips, voice inputs, party details, and trade information.
You are responsible for ensuring that you have the right to upload and process any data you submit, including data about third parties (such as your customers and suppliers).
You are responsible for verifying generated outputs — including extracted slip fields and GST invoices — before relying on them for accounting, tax, or commercial purposes.
You are responsible for complying with all laws applicable to your business, including tax, GST, and record-keeping laws.

5. Acceptable use

You agree not to:

Use the services for any unlawful, fraudulent, or deceptive purpose;
Upload content that you do not have the right to upload, or that infringes the rights of others;
Attempt to reverse-engineer, scrape, or interfere with the services or their underlying infrastructure;
Use the services to build a competing product or to train competing models;
Use the services to generate falsified invoices, evade taxes, or otherwise misrepresent commercial transactions.

We may suspend or terminate accounts that violate these rules.

6. AI-generated output

FactoryBuddy uses third-party AI models, including Google's Gemini, to extract fields from slips and to power voice input. AI output may contain errors. You are responsible for reviewing all extracted and generated content before relying on it. We do not warrant that AI output is complete, accurate, or fit for any particular regulatory purpose.

7. Intellectual property

The services, including all software, design, and branding, are owned by Brunhart AI and protected by applicable intellectual property laws. You retain ownership of the trade data, slips, and content you upload. You grant us a limited licence to host, process, and display that content solely to provide the services to you.

8. Fees

Some features may be offered free of charge during early access; paid plans may be introduced later. Where fees apply, they will be presented to you before you incur a charge.

9. Disclaimer of warranties

The services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that AI extractions will be accurate.

10. Limitation of liability

To the maximum extent permitted by law, Brunhart AI and its founders shall not be liable for any indirect, incidental, special, consequential, or exemplary damages — including loss of profits, loss of business, loss of data, or loss of goodwill — arising out of or in connection with your use of the services. Our aggregate liability for any direct damages shall not exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim, or, where no fees have been paid, ₹10,000.

11. Indemnity

You agree to indemnify and hold Brunhart AI harmless against any claims, damages, or expenses arising from your misuse of the services, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using the services at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the service. On termination, sections that by their nature should survive — including intellectual property, disclaimers, liability limits, and governing law — will survive.

13. Governing law

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Ludhiana, Punjab, India.

14. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated in the app or by email. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
